6.1.4. For the purposes of handling disputes or defending the legal interests of K2 College, in accordance with the requirements of applicable legal acts, some of your personal data may be obtained from national registers, specialized debtor databases, courts, other dispute resolution institutions, bailiffs.
7. ON WHAT LEGAL BASIS DO WE COLLECT AND PROCESS YOUR PERSONAL DATA?
7.1. K2 College is allowed to collect and process your personal data only in accordance with the legal grounds specified in the applicable legal acts:
7.1.1. On the legal basis of your consent – for example, when K2 College conducts direct marketing or digital marketing, sends you newsletters or offers for the purchase of goods or services;
7.1.2. On the legal basis of concluding and executing a contract, agreement or other transaction with you – when the processing of your personal data is necessary for K2 College to fulfill its contractual obligations towards you or to take certain actions before the start of contractual relations with you;
7.1.3. On the legal basis related to the fulfillment of legal obligations applicable to K2 College – when the processing of your personal data must be carried out in order for K2 College to be able to fulfill its statutory obligations indicated in the laws or other legal acts (for example, accounting management, official reporting, tax related obligations), as well as in order for K2 College to be able to fulfill its obligations under legal orders, decisions, requests or demands of public, state, municipal or EU authorities, judicial and law enforcement authorities;
7.1.4. On the legal basis of the implementation and/or protection of the legitimate interests of K2 College or third parties – for example, in the case of the investigation of disputes with you, the administration and/or collection of your debts towards K2 College.

8. HOW LONG ARE YOUR PERSONAL DATA PROCESSED AND STORED?
8.1. K2 College stores your personal data for no longer than it is required in accordance with the purposes of data processing or required by applicable legal acts, if a longer data storage period is stipulated in such legal acts. If the applicable legal acts do not specify the storage terms for documents containing personal data, these documents are stored
8.2. Please note that in certain cases, a longer period of mandatory storage of personal data or the right for K2 College to store your personal data for a longer period may be determined by legal acts, for example, in cases where the processing of personal data is necessary in order for K2 College to comply with the requirements set out in the legal acts applicable to K2 College, or when a longer period of the processing of personal data is necessary to evaluate, enforce or defend legal claims. In such cases, we can process your personal data for a longer period, but only as much as is necessary for these personal data processing purposes.
8.3. Personal data will be destroyed immediately when they are no longer needed, including cases where their storage periods or periods of storage of documents containing your personal data have expired.
9. TO WHOM WE MAY PROVIDE YOUR PERSONAL DATA?
9.1. When K2 College processes your personal data, situations may arise when we have to transfer your personal data:
9.1.1. To you, in case of our communication with you or when you exercise your rights as a data subject in relations with K2 College as provided for in this Privacy Policy, contracts, agreements or other transactions concluded between you and K2 College, as well as when it is indicated in the applicable legal acts;
9.1.2. To K2 College employees, personnel, legal representatives or agents for whom your personal data is necessary in order for them to be able to perform their work or other functions in relation to K2 College;
9.1.3. To service providers engaged by K2 College, such as individual lecturers, teachers, consultants, accounting companies, accountants, auditors, legal advisors, e-mail service providers, data server/cloud service providers, etc., K2 College’s internal document/data management system manager or supervisor;
9.1.4. K2 College may cooperate with and use companies of its corporate group (for example, parent or subsidiary companies) or their personnel for certain functions related to the sale and/or provision of K2 College goods or services to you, communication with you or external entities, K2 College partners (for example, network of your potential employers), as well as to carry out internal administration tasks or functions. In such a case, your personal data may be transferred to these entities, to the extent necessary for their functions or tasks. Such entities may be, for example, UAB “Vilnius Coding School” (legal entity code: 304299909, registered head office address – Žalgirio g. 90-100, LT-09303, Vilnius, Lithuania), SIA “Riga Coding School” (legal entity code: XXX, registered head office address – XXX, Latvia), Dublin Coding School (legal entity code: XXX, registered head office address – XXX, Ireland), Prague Coding School (legal entity code: XXX, registered head office address – XXX¸ Czech Republic).
Please note that in most cases specified in this Privacy Policy or other internal procedures of K2 College, K2 College acts as a separate and independent controller of your personal data. However, in certain cases, when it is specified separately in this Privacy Policy, in other legal documents of K2 College, or in separate notifications provided to you, all or some companies of the K2 College corporate group may act as joint controllers of your personal data. In such cases, an agreement is concluded between K2 College and other companies within the corporate group, under which, as joint controllers of personal data, we define our responsibility for fulfilling the obligations set out in the GDPR. Nevertheless, you can exercise your rights as a data subject both in relation to K2 College and any other company within the K2 College corporate group.

To dispute resolution institutions (courts, commissions, arbitrations, pre-trial dispute resolution entities, etc.), debt collection agencies, bailiffs, supervisory authorities (consumer rights protection agencies, data protection agencies, etc.), in case of a dispute between you and K2 College, K2 College‘s audits or other inspections, or when K2 College administers or collects your debt.
9.1.6. To the local tax authorities (tax administrators), as far as it is necessary to fulfill tax and other accounting related obligations of K2 College.
9.1.7. In the event that you purchase goods or services of K2 College using state, municipal, EU or other public funding, your personal data may be transferred to organizations providing and administering such funding;
9.1.8. To K2 College’s insurance companies when it is related to the insured event, damage assessment and/or compensation issues;
9.1.9. To K2 College partners, for example network of your potential employers, in order to help you find a potential job or internship with K2 College partners with your consent;

9.2. K2 College takes care and strives to ensure that your personal data will be transferred to other entities only in the event that the intended purpose requires it, and only to the extent necessary to achieve the desired purpose. K2 College enters into confidentiality agreements and data processing agreements with such entities to which it transfers your personal data. The mentioned legal documents define how these entities handle your personal data and what personal data security measures are applied for processing of your personal data.
9.3. With your consent or if a situation arises in which we would be legally obligated to transfer your personal data outside the European Union and the European Economic Area, K2 College takes appropriate additional measures to ensure adequate protection of your personal data and compliance of such transfer with GDPR requirements.
10. HOW DO WE ENSURE THE SECURITY OF YOUR PERSONAL DATA?
10.1. The legal, appropriate and correct processing of your personal data, as well as ensuring its security, is one of the most important priorities of K2 College, therefore we take the processing and safety of your personal data very seriously.
10.2. In order to collect and process your personal data legally, transparently and securely, we plan and implement various technical and organizational measures for personal data security in our organization, as well as in the network of the K2 College corporate group and in our relations with our partners:
10.2.1. We apply and follow this Privacy Policy, our internal rules and other legal documents in which we establish the legal bases, purposes, reasons for collecting and processing your personal data, personal data and their scope, the nature of personal data processing, the technical and organizational measures applied, we define the sources from which we collect or receive your personal data, how long we store your personal data, to whom and for what purpose we can transfer your personal data, how we ensure the security of your personal data, how we ensure the implementation of your rights as a data subject, how and when we delete / remove your personal data, etc.;
10.2.2. We sign confidentiality agreements and/or data processing agreements with our employees, assistants, advisors, partners and entities used, as well as other entities that may access your personal data if there is a legal basis. By the documents mentioned we oblige the aforementioned entities to keep your personal data confidential, and we agree on how your personal data must be processed in order to ensure the principles and security requirements for the processing of your personal data provided for in the applicable legal acts and applied by K2 College;
10.2.3. We regularly conduct trainings for the personnel of K2 College and its corporate group companies on the topics of personal data security and privacy;
10.2.4. We apply physical protection of your personal data, for example, we limit and control, as necessary, access to the premises where your personal data is processed or stored;
10.2.5. We apply technical security measures, such as regular updates and maintenance of computer hardware and software, application of anti-virus software, VPN, firewall protection, application of secure communication channels, data encryption, electronic access control mechanisms, limitation of access to the personal data based on the “need to know” principle, making regular backup copies of personal data, storage personal data in different locations, etc.
10.2.6. We also apply other measures for the processing and security of your personal data.
10.3. K2 College regularly updates and improves the security measures for the processing of your personal data.
11. YOUR RIGHTS
11.1. In accordance with the provisions of the GDPR, for the purpose of transparent and legal processing of your personal data, you as data subject have the following rights:
11.1.1. the right to apply to K2 College with a request to provide information about your personal data processed by K2 College (the right to access processed personal data);
11.1.2. the right to apply to K2 College with a request to correct your personal data and/or stop the processing of such personal data, with the exception of storage, in the event that after reviewing the personal data, you determine that the data is incorrect, incomplete or inaccurate;
11.1.3. the right to apply to K2 College with a request to destroy (delete) personal data or to stop the processing of such personal data, with the exception of storage, in the event that after familiarizing yourself with your personal data, you determine that personal data is being processed illegally or dishonestly, the personal data being processed is excessive or there are other bases established in applicable legal acts;
11.1.4. the right to object to the processing of your personal data when such data is processed or intended to be processed for direct marketing purposes, or due to a legitimate interest pursued by K2 College or a third party to whom personal data is provided;
11.1.5. the right to withdraw the given consent to the processing of your personal data, without affecting the legality of the processing of this personal data carried out before the withdrawal of consent;
11.1.6. the right to demand for restriction of the processing of your personal data, if you believe that the data is processed illegally or incorrectly, and you wish that the processing of your personal data would be limited to their storage. In this case, the processing of your personal data will be limited to their storage until a legal basis for applying other processing actions is established or until it is determined whether the legitimate interests of K2 College outweigh your interests;
11.1.7. the right to data portability,e. to receive the personal data relating to you that you have provided to K2 College in a structured, commonly used and computer-readable format and to forward this data to another controller of your personal data, or to request that K2 College would directly forward such personal data to another controller where technically possible and if this does not cause K2 College additional financial costs.
11.2. Please note that according to the GDPR, not all requests submitted by you regarding the exercise of your rights must be satisfied. Therefore, K2 College may refuse your requests or demands in cases established by law, for example, when it is necessary to ensure state security or defense, public order, prevention, investigation, detection or prosecution of criminal acts, important economic or financial interests of the state, prevention of violations of official or professional ethics, for investigation and detection, protection of the rights and freedoms of you or other persons, as well as in other cases where the applicable legal acts give K2 College the right to refuse to fulfill your request or demands for the exercise of rights.
